Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the apexclimatepro.com website (the “Site”) operated by APEX Climate Pro(“we,” “us,” or “our”). By using the Site you agree to these Terms. If you don't agree, please don't use the Site.

1. Scope of these Terms

These Terms cover your use of the Site itself, including online booking requests. The actual cleaning and air-quality services we perform at your property are covered by the written service agreement, work order, or invoice we provide before starting any work. If those documents conflict with these Terms, those documents control as to the services performed.

2. Use of the Site

You agree to use the Site only for lawful purposes. You agree not to:

  • Submit false, misleading, or fraudulent information through any form on the Site
  • Attempt to gain unauthorized access to any part of the Site or its underlying systems
  • Interfere with the operation of the Site or any other user's use of it
  • Use the Site to transmit malware, viruses, or any harmful code
  • Scrape, copy, or harvest content for resale without our written permission

3. Booking requests and appointments

Submitting a booking form is a request for service, not a confirmed appointment. We will contact you to confirm availability, scope, and price. A binding service agreement is formed only when we provide a written estimate or work order and you accept it.

4. Estimates, pricing, and warranties

Pricing communicated through the Site is general guidance and is not a binding quote. All pricing for actual services will be provided in writing before work begins. Any manufacturer or workmanship warranties will be set forth in the written service agreement or invoice.

5. Intellectual property

The Site, including its text, graphics, logos, layout, and software, is owned by APEX Climate Pro or our licensors and is protected by copyright, trademark, and other laws. You may view and print pages for personal, non-commercial use. Any other use requires our written permission.

6. Third-party content and links

The Site may include links to third-party websites or services that we don't control. We aren't responsible for the content, policies, or practices of those third parties. Following a link is at your own risk.

7. Disclaimers

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS.

8. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, APEX CLIMATE PRO AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

9. Indemnification

You agree to defend, indemnify, and hold harmless APEX Climate Profrom and against any claims, damages, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Site or violation of these Terms.

10. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute arising from the Site or these Terms shall be brought exclusively in the state or federal courts located in Brevard County, Florida, and you consent to the jurisdiction of those courts.

11. Changes to these Terms

We may update these Terms from time to time. The “Effective” date at the top reflects the most recent revision. Continued use of the Site after we post changes constitutes your acceptance of the updated Terms.
